Reese Marketos Settles Trademark Fight Over “Vizzy” Hard Seltzer

Pete Marketos represented Molson Coors Beverage Co. in a trademark lawsuit that alleged its “Vizzy” line of hard seltzers infringed on Texas brewer’s “Brizzy” brand. The lawsuit was settled after Future Proof failed to win an injunction with Future Proof stopping all marketing and production of Brizzy while other details of the settlement were not made available to the public. The appeals court siding with Marketos and Molson stated “Neither company was the first to have the inspiration to brand a carbonated product with a variant of “fizzy” [and] the cans are dissimilar in a variety of ways.
